COVID-19 Marriage License Issuance Process

Due to COVID-19, in order to ensure the safety of our customers and employees, the following process for issuing Marriage Licenses has been established:

  • The Durham County Register Office will issue in person Marriage Licenses by Appointment Only.
  • Our office will not accept any walk-in applicants without a previously scheduled appointment.
  • All applicants are required to complete the online application in advance before an appointment will be scheduled.
  • On scheduled appointments, only applicants should appear in the office .  No additional guest(s).
  • Upon entering the building, please remember the following precautions and adhere to the CDC Guidelines to minimize the transmission of COVID-19:
  • Mask are required to enter all public places in Durham, North Carolina.
  • Maintain social distance - six feet requirement.
  • Wash/sanitize hands regularly.

Once you have submitted your application and have emailed or faxed your documents, including the Contact Information Sheet, please call 919-560-0495 to schedule your appointment.

Requirements for obtaining a Marriage License in Durham County, North Carolina
• Applicants must not already be married.
• Applicants must be getting married within 60 days of license issuance.
• Applicants must be getting married in the State of North Carolina.
• $60.00 (Cash, Money Order, or Cashier's Check) is the fee to obtain a marriage license.

Documents required for processing:
All applicants must present one of the following valid (not expired, and legible) forms of identification:

o Current Driver's License
o Current State Issued Identification Card
o Current Passport
o Military Identification

Names on Identification and social security documents must match (first, middle, and last name).

• All applicants must present a Social Security Card or a legal document with their full Social Security number on it (ex. Recent W2 within two (2) years, Insurance Policy, or a letter from their bank on the bank letterhead).
o If an applicant(s) has never been assigned a Social Security Card, an affidavit form will be provided for completion at the Register of Deeds Office.

Applicants 18 – 21 years of age must provide a certified copy of their birth certificate along with applicable identifications.

Notice

Effective January 1, 2019 , all persons applying for a Marriage License in Durham County will be required to provide proof of dissolved previous marriage if it occurred within the last 12 months.

If this is not your first marriage, and your previous marriage ended in the last 12 months by (Divorce, Death, or Annulment) you must provide acceptable proofs.

Acceptable proofs:

  • If your last marriage ended in Divorce - the acceptable proof is a certified copy of the divorce decree.
  • If your last marriage ended by spousal Death - the acceptable proof is a certified copy of the death certificate.
  • If your last marriage ended by court ordered Annulment - the acceptable proof is the certified court ordered annulment.

Applicants under the age of eighteen (18), please contact the office of the Register of Deeds, Marriage License Division at (919)560-0480 for requirements.

• A marriage license application is valid for 60 days from date of issuance. If the marriage license application is not returned to the Register of Deeds office for recording within 60 days of issuance, the license will expire.

• Applicants with expired marriage license applications will be required to apply for a new license with applicable fees.

• Marriage License are issued at the Office of the Register of Deeds, between the hours of 8:30 a.m. and prior to 4:30 p.m., Monday through Friday, except major holidays.

• Marriages are not performed by the Register of Deeds office.

• In an effort to increase our processing time, and ensure accuracy of your records, we strongly suggest completing your marriage license application online and submitting prior to visiting our office.

Certified copies of your marriage license are $10.00 each (cash, money order, or cashier's check).

Certified copies are not automatically mailed, they must be requested.

• Online using the Online Vital Records Request Form
o State issued identification required

• By Mail Request to:
